These Terms of Service ("Terms") govern your use of the GlucoseScan mobile application and related services (collectively, the "Service") operated by GlucoseScan ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

1. Acceptance of Terms

By downloading, installing, or using the GlucoseScan app, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

GlucoseScan is a mobile application that provides:

• Food scanning and recognition capabilities
• Glucose level prediction based on food intake
• Dietary recommendations and insights
• Health tracking and monitoring features
• Educational content about nutrition and glucose management

3. User Accounts and Registration

To access certain features of our Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information as necessary

• Notify us immediately of any unauthorized use of your account

Medical Contraindications

GlucoseScan is NOT intended for use by:

• Individuals with Type 1 diabetes or those who use insulin
• People with kidney disease or kidney-related conditions
• Pregnant individuals
• Individuals being treated for eating disorders (ED)
• Anyone under the age of 18 without parental consent

If you fall into any of these categories, please consult with your healthcare provider before using our Service. Our predictions and recommendations are not suitable for your specific medical needs and may not be accurate for your condition.

5.3 Wellness Use Only

GlucoseScan is intended solely for wellness, lifestyle, and educational purposes. It is not designed, certified, or intended for use as a medical device, diagnostic tool, or treatment aid. The Service must not be used in situations requiring real-time medical monitoring, life-supporting decisions, or any activity where inaccurate predictions could reasonably result in injury, disability, or death.

5.4 User Screening

By using our Service, you confirm that you do not fall into any of the contraindicated categories listed in Section 5.2. We reserve the right to suspend or terminate access for users who misrepresent their eligibility or use the Service contrary to these limitations.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by GlucoseScan and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

8. User Content

You retain ownership of any content you submit to our Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of providing and improving our Service.

You are responsible for ensuring that your content does not violate any applicable laws or the rights of others.

8.3 Indemnification

You agree to indemnify, defend, and hold harmless GlucoseScan, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with:

• your access to or use of the Service,
• your violation of these Terms, or
• your content, including but not limited to any claim that your content infringes or misappropriates the intellectual property rights of a third party.

9. Limitation of Liability

To the maximum extent permitted by law, GlucoseScan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9.1 Maximum Liability

To the fullest extent permitted by law, the total liability of GlucoseScan and its affiliates, officers, employees, and agents for any claims under these Terms, including for any implied warranties, is limited to the amount you paid us, if any, to use the Service in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the Service.

11A. Data Handling and Retention

We process and store data in accordance with applicable data protection laws. By using the Service, you consent to the transfer and storage of your information outside your country of residence, including jurisdictions that may not provide the same level of data protection. We will not retain personal information longer than is necessary to provide the Service or comply with our legal obligations.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

12.1 Dispute Resolution

All disputes, controversies, or claims arising out of or relating to these Terms or the use of the Service shall be resolved exclusively in the courts of Victoria, Australia, and you consent to the jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
